General terms and conditions

The hirer declares to accept these general rental conditions. The signatory of the present contract binds both himself and his possible principal. Any service may validly be made at the address given by the signatory of the contract, that of the tenant's residence or head office.

Art 1. Provision of the E scooter

Unless damages or mechanical defects are explicitly mentioned on the delivery document describing the condition of the E-scooter, signed by the parties involved upon handing over the vehicle, the hirer acknowledges that he has received a vehicle whose bodywork and mechanics are in good condition, equipped with full equipment. The hirer bears responsibility for all accessories. Once signed, this receipt is binding. If, during the rental, he shall immediately stop using the vehicle and shall immediately contact the lessor in order to agree on the measures to be taken. agree on the measures to be taken (e.g. return of the E Scooter, immobilisation of the E Scooter pending the arrival of a mechanic, possible return of the E Scooter to the rental company). mechanic, possible reimbursement of the rental fee, etc.) If the Renter fails to do so, he will be liable for all damages arising from the use of the vehicle in this state.

Art. 2. Steering of the E-scooter

a.) The E Scooter must be driven by the driver mentioned on the contract under the heading "Customer details" and is intended for a maximum of 2 persons only. In the absence of specific clarifications

the renter the authorised driver.

b.) Subject to other restrictions or exceptions, the driver(s) must be at least 18 years of age.

c.) The renter is fully liable for the proper execution of the contract and he will be held liable for damages caused to the E Scooter in accordance with the general and specific terms of the rental contract. In the event that the E Scooter has been entrusted to or used by an unauthorised driver, the Renter acknowledges that he assumes full responsibility, towards Visit Kinrooi vzw, as towards third parties and acknowledges that he loses all the benefits of limitations of responsibility to which he has subscribed, and which are described in the following paragraphs 5.2 to 5.2.4.

Art. 3. Use of the E Scooter and obligations of Renter

With respect to the use of the E Scooter, Renter undertakes to: a) Comply with the laws and regulations in force, especially but without limitation, regarding traffic, parking, customs and transport. Any fine or other cost due for any breach or violation has been served on the Renter, the Renter - in addition to the amount of such breach or violation - will owe a sum of €40.00 ex VAT for administrative costs per breach or violation, and this sum may increase to €80.00 ex VAT in case of non-payment within a period of 7 days.

a.) The lessor, Visit Kinrooi, reserves the right to assess the abilities and skills of participants to use the E scooter

within the scope of its services. The renter declares to be able to use the E scooter and not to have any medical limitation to this end.

b.) Not to use the E scooter in a state of intoxication or under the influence of alcohol, narcotics drugs or if he is unable to control his

actions.

c.) Before departure, the renter can try out the E scooter. If it does not meet his/her expectations, he/she can ask for a replacement. Once the hirer has left, he/she accepts the condition of the E scooter.

d.) To use the E scooter as a good family man, which explicitly but only by way of example excludes the use while riding of devices such as a walkman, a mobile phone that cannot be operated without hands, etc....

e.) To use the E scooter for normal, ordinary and non-harmful use on passable, suitable asphalt or paved roads. The parties expressly agree, but only by way of example, that this excludes the following: the transport of dangerous, harmful, flammable, explosive or corrosive substances; competitions, as well as their preparation, road tests and driving lessons. the public transport of passengers or the transport of passengers for a fee, whether or not the fee has been expressly or tacitly stipulated; the use of the vehicle for courier service.

f.) The E scooter preferably to be used only on the pre-programmed routes.

g.) Not to make any publicity on the E scooter except with the written consent of the Rental Company.

h.) Not to load the E scooter with goods that may damage it.

i.) Not to make any modification, even minimal, to the E Scooter.

j.) Not to sublet the E Scooter, nor to entrust or hand over the E Scooter free of charge or for consideration, nor to pledge the E Scooter or dispose of or otherwise dispose of it.

k.) To take the most comprehensive precautions to avoid the E Scooter being damaged, accosted or stolen. Failure to comply with these measures the Hirer runs the risk of having to reimburse the Lessor for all damages resulting therefrom. Will be considered a serious fault, failure to comply with the following points: b.), e.) and f.).

l.)If the E-scooter is rented for more than one day, the renter is obliged to fully charge the batteries AFTER use.

Art. 4. Return of the vehicle

4.1 Return

The E Scooter will remain in the custody of the Renter until it is returned. The return of the E scooter with the keys, tyres, documents and equipment - this is not an exhaustive list - is done in the hands of an authorised staff member of the Lessor at the place and date as agreed and indicated on the contract and this during office opening hours. If this is not the case, the tenant will have to compensate Visit Kinrooi vzw for any new damage and/or thefts that are

established by the lessor. Unless he would have communicated a certain damage to the lessor in accordance with the data on the document signed in advance by the hirer and lessor, called 'statement of findings', the hirer shall, if he wishes, at the time of the return of the vehicle, have the possibility of the vehicle, have the opportunity to proceed to a counter-examination of the vehicle in order to ascertain any damage to the body or mechanics determination.

4.2 Extension of rental period

Any extension of the rental period must be requested in writing to and accepted by the lessor. The hirer who fails to return the vehicle at the time provided for in the contract, exposes himself to civil and criminal prosecution as well as a continuation of the invoicing as provided for in the present contract without this implying a tacit extension of the contract. Furthermore, in such case, the Renter authorises the Rental Company to immediately recover the E Scooter where it is located, subject to prior notice, and releases the Rental Company from any liability for any damage or costs resulting from such recovery, including the loss or damage to any item contained in the E Scooter, unless such damage or loss was caused by intent or gross negligence on the part of the Rental Company or its appointee, which the Renter must be able to prove. Taking into account the return obligations imposed on the Rental Company by its suppliers, the Renter undertakes to exchange the E Scooter for an E Scooter of the same category on the date fixed by the Rental Company. If no such exchange takes place on the date foreseen, Renter reserves the right to recover from Renter the financial loss followed by the refusal to exchange.

Art. 5. Insurance, liability and charge

5.1 Insurance, liability and liability for damage or loss of the vehicle

5.1.1. The rented E scooter is insured for civil liability (BA) in accordance with the statutory provisions and the Royal Decree of 14 December 1992 on the model contract. Civil Liability: if the insured E Scooter is rented by an individual, the driver indicated in the rental contract must be at least 18 years of age and an exemption in the guarantee BA of EUR 500,00 applies. If the vehicle would nevertheless be driven by someone younger than 18, the exemption BA is EUR 1,500.00 instead of EUR 500.00.

5.2. Theft, embezzlement, vandalism and theft cover: called 'TP'/'STP'. The Renter accepts full liability for the disappearance of the vehicle and/or parts, to the extent of the total value of the E Scooter and/or the costs associated with the recovery of the unreturned

E scooter.

5.2.1. The Renter shall be liable for the loss of and/or any damage to the E Scooter during the rental, and this until the E Scooter is returned

in accordance with Clause 4 above. The total value of the vehicle is available on simple request at the rental office. The responsibility limitations apply per accident, i.e. per individual case. The renter agrees that all damages will be paid from his remote sales credit card.

5.2.2. Visit Kinrooi shall not be liable for damages, direct or indirect and of any nature whatsoever, regardless of how they arose and the persons by whom the damage was caused.

Art. 6. Payment

The renter undertakes to pay the following amounts in cash on commencement of the rental of the E scooter or otherwise agreed .

a.) The amount of the rental, calculated according to the applicable rate and based on the number of rental days.

b.) Under no circumstances can the Renter recover damages or interest for usage problems or loss of enjoyment during the rental period.

Art. 7. Terms of payment

Via the bank account to Visit Kinrooi or in cash.

Art. 8. Collection costs

In addition to the penal clause and the negligence interest, the tenant will be held responsible for the costs of judicial collection as stipulated in the Act of 21 April 2007 and the Royal Decree of 26 October 2007.

Art. 9 Parking fine

All parking fines are the responsibility of the tenant. The tenant agrees that all fines will be paid from his remote sales credit card.

Art. 10. Modification of the contract

Any change made to the terms and conditions of this contract that has not been agreed in writing shall be void and of no effect.

Art. 11. Nullity

The nullity of one or more clauses of the contract shall in no case entail the nullity of the other clauses or of the contract.

Art. 12. Jurisdiction of the courts

The contract is subject to Belgian law. Any dispute arising from it will be subject to the competent courts. Rental contract read and approved by the tenant.
