General terms and conditions e-Steps
The tenant declares that he accepts these general rental conditions. The signatory of the present contract binds both himself and his possible principal. Any service may be validly effected at the address given by the signatory of the contract, that of the hirer's residence or head office. tep
Art. 1 Provision of the vehicle
Unless damage or mechanical defects are explicitly mentioned on the delivery document describing the condition of the vehicle, signed by the parties involved when handing over the vehicle, the hirer acknowledges that he has received a vehicle whose bodywork and mechanics are in good condition, equipped with the full equipment. The hirer bears responsibility for all accessories. Once signed, this receipt is binding. Should the hirer discover a mechanical problem during the rental period, he shall immediately stop using the vehicle and shall immediately contact the lessor in order to agree on the measures to be taken (e.g. returning the vehicle, immobilising the vehicle while awaiting the arrival of a mechanic, possible reimbursement of the rental fee, etc.). If the hirer does not do so, he will be obliged to compensate all damages resulting from the use of the vehicle in this state.
1.1 Condition of the step(s). Step Tours and Visit Kinrooi vzw assure that the step(s) are roadworthy and suitable for renting. The renter acknowledges to have received the step(s) in the condition as it appears on receipt, cleaned according to the rules of the art. Upon return of the scooter(s), the condition of the step(s) will be determined. Any costs incurred to restore the step(s) to the condition they were in at the start of the agreement will be borne by the hirer.
1.2 Maintenance of the step(s). Costs of normal maintenance and repair are at Step Tours' expense. Costs resulting from negligence on the part of the lessee shall be at the lessee's expense. The hirer may not have repairs of any kind made to the step(s).
Art. 2. Reservation, change(s) and right of withdrawal
2.1 Reservation system and right of withdrawal. Reservations for one or more steps can be made via the website https://www.steptours.be or www.visitkinrooi.com. The system displays the current availability per rental point once You have first selected the desired date. If the rental agreement with Step Tours is concluded on site, there is no right of withdrawal. If the rental agreement is concluded remotely or outside Step Tours' sales premises, the hirer has the right, in accordance with art. VI. 73 WER, to revoke the agreement within a period of 14 days without giving reasons. The withdrawal period expires 14 days after the day on which the agreement was entered into. When the contract has been fully performed, the right of withdrawal will in any case extinguish. To exercise the right of withdrawal, the tenant must inform Visit Kinrooi of his decision to withdraw from the agreement by unequivocal statement (by electronic mail: welkom@visitkinrooi.com). This can also be done by using the model form provided in Annex 2 of Book VI of the Economic Code. To comply with the withdrawal period, it is sufficient for the hirer to send his/her communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. In case of excessive use of the right of withdrawal by a tenant, Visit Kinrooi reserves the right to refuse future orders.
2.2 Conclusion and duration of the agreement. The agreement starts after the (electrical) signing of the general terms and conditions. The rental period commences on the date and time as agreed at the time of reservation. The rental of the step(s) ends when the step is received again by Visit Kinrooi.
2.3 The rental period. The renter is obliged to return the rented step(s) in time. The step(s) must be returned at the same place as the place of collection, unless explicitly agreed otherwise. If step(s) are returned to Visit Kinrooi earlier than the agreed period, this shall not give rise to (partial) reimbursement of the agreed rental price. In case of late return of the scooter(s), a fixed amount of €50 per started hour and per scooter will be charged. If the step(s) are not returned, Step Tours and/or Visit Kinrooi reserve the right to take further legal action against the renter.
2.4 Dissolution of the rental agreement. In case of bankruptcy, judicial or extrajudicial liquidation or apparent insolvency of the renter, Visit Kinrooi shall be entitled, after conclusion of the agreement, to regard the rental agreement as dissolved by operation of law and without prior notice of default. In case of use of the scooter(s) in violation of the present agreement, Visit Kinrooi shall also be entitled to consider the rental agreement/provision agreement as terminated ipso jure and without prior notice of default, with payment by the entitled party of a fixed and irreducible compensation amounting to €800.
2.5 Changes in the number of steps to be rented must be requested by mail to Visit Kinrooi after reservation. This can be done no later than 24 hours prior to the start of the rental period. Step Tours may ask the renter in writing (by mail) to terminate the agreement early (cancellation) no later than 24h prior to commencement of the rental period if the change of circumstances (adverse weather conditions, illness, pandemic, ...) disproportionately inconveniences the execution of the agreement, to such an extent that the execution can no longer reasonably be demanded, that the change was unforeseeable at the time of contract conclusion, that the change was unaccountable at the time of contract conclusion and that the change is unaccountable to the debtor of the commitment. The hirer may request in writing (by e-mail) to terminate the contract early (cancellation) no later than 24 hours before the start of the rental period. However, the tenant must then comply with the cancellation fees below:
- in case of cancellation more than the last month before the start of the rental period: no costs
- in case of cancellation during the last month: 30 per cent of the total amount,
- in case of cancellation during the last two weeks: 50 per cent of the total amount,
- in case of cancellation during the last week: 75% of the total amount.
- if cancelled the day before or the day of the start of the rental period: 100 per cent of the total amount.
With some rental orders Visit Kinrooi also has to take care of additional reservations, such as the rental of a bus, guide, reservation of a museum visit or reservation in a catering establishment. In case of cancellation, an administrative cost of 100 euro per cancelled reservation order will be charged. If the bodies involved in the additional reservations also charge cancellation costs, these will simply be passed on. In exceptional cases, costs have already been incurred for orders, such as the development of an adapted route, study of special guide content, editorial work, special contacts with third parties, etc... In the event of cancellation, the costs already incurred will be passed on. In specific situations, different or specific cancellation agreements may be made in mutual consultation with a group. These must always be confirmed in writing by both the lessee and Visit Kinrooi.
Art. 3. Driving of the vehicle
a.) Without prejudice to the stipulations in the current General Rental Conditions regarding the use of the scooter, people must be at least 18 years old to be able to place an order and/or sign an agreement with Step Tours. b.) The vehicle must be driven by the driver mentioned on the contract under the heading ‘Customer details’. In the absence of specific clarifications, the renter becomes the authorised driver. c.) Subject to other restrictions or exceptions, the driver(s) must be at least 18 years old. d.) The hirer is fully liable for the proper execution of the contract and he will be held liable for damage caused to the vehicle in accordance with the general and specific terms of the hire contract. In the event that the vehicle was entrusted to or used by an unauthorised driver, the renter acknowledges that he assumes full responsibility, both towards Step Tours and Visit Kinrooi vzw, as well as towards third parties, and acknowledges that he loses all the benefits of responsibility limitations for which he has subscribed, and which are described in the following paragraphs. e.) For the rental of electric step(s), which by their mechanical power do not go faster than up to 25 km/h, in accordance with Belgian traffic regulations, one should not be in possession of a driving licence. The renter must be in possession of a valid identity card or passport. The renter must be over 18 years of age. If several scooters are rented to the same renter, each person must be at least 18 years old. Wearing a helmet is not required by law, but recommended. It is not compulsory to wear protective clothing, but it is advisable to provide suitable clothing. Slippers and high heels are not recommended. Sunglasses are recommended against flying insects and strong sun.
Art. 4. Use of the vehicle and obligations of the renter
The renter is responsible for any violation of the contractual provisions as well as the laws and traffic regulations in force, of the country where the renter would be travelling with the step(s) during the rental period.
At the request of the police, Step Tours and Visit Kinrooi vzw may provide the renter's personal data to them. This is done within the legal framework concerning privacy and protection of personal data.
The renter is prohibited from using the step(s):
- To use it to push or drag any other object;
- To use for illegal purposes;
- To sublet;
- To use for competition(s);
- To use for paid goods rental;
- To be used for courier services;
- To be used for transporting animals;
- To be used for rental or training purposes;
Any breach of any of the above provisions gives Step Tours and Visit Kinrooi vzw the right to terminate the agreement automatically and without any notice of default at the hirer's expense without the hirer being able to claim a refund of unused rental fees, subject to proof of greater damage.
Art. 5. Return of the vehicle
5.1 Return. The vehicle remains in the custody of the hirer until its return. The return of the vehicle with the keys, tyres, documents and equipment - this is not an exhaustive list - shall take place in the hands of an authorised staff member of the lessor at the place and date as agreed and indicated on the contract and this during office opening hours. If this is not the case, the tenant will have to compensate Visit Kinrooi vzw for any new damage and/or thefts ascertained by the lessor. Unless he would have communicated a certain damage to the lessor in accordance with the details on the document signed beforehand by the hirer and the lessor, called “state of finding” , the hirer shall, if he wishes, at the time of the return of the vehicle, have the possibility to proceed to a counter-inspection of the vehicle in order to determine the possible damage to the bodywork or the mechanics.
5.2 Extension of rental period. Any extension of the rental period must be requested in writing to the lessor and accepted by him. The hirer who fails to return the vehicle at the time provided for in the contract, exposes himself to civil and criminal prosecution as well as to a continuation of the invoicing as provided for in the present contract without this implying a tacit extension of the contract. Furthermore, in such a case, the hirer authorises the lessor to repossess the vehicle immediately where it is located, subject to prior notice, and releases the lessor from any liability for any damage or costs resulting from such recovery, including the loss or damage to any object in the vehicle, unless such damage or loss was caused by intent or gross negligence on the part of the lessor or his employee, which the hirer must be able to prove. Taking into account the return obligations imposed on the lessor by his suppliers, the hirer undertakes to exchange the vehicle for a vehicle of the same category on the date fixed by the lessor. If no such exchange takes place on the scheduled date, the lessor reserves the right to recover the financial loss followed by the refusal to exchange from the hirer.
Art. 6. Insurance, liability and assumption of damage or risk of disappearance of the vehicle
6.1 Insurance, liability and liability for damage or loss of the vehicle 6.1.1. The rental vehicle is insured for civil liability (BA) in accordance with the legal provisions and the Royal Decree of 14 December 1992 on the model contract. Civil liability: if the insured vehicle is hired by an individual, the driver indicated in the hire contract must be at least 18 years of age and an exemption from the civil liability guarantee of EUR 500.00 applies. If the vehicle would nevertheless be driven by someone younger than 18, the exemption BA amounts to EUR 1,500.00 instead of EUR 500.00.
6.2. Theft, embezzlement, vandalism and theft cover: called “TP”/'STP'. The hirer accepts full liability for the disappearance of the vehicle and/or parts, to the extent of the total value of the vehicle and/or of the costs associated with the recovery of the unreturned vehicle.
6.2.1. The hirer is liable for the loss of and/or any kind of damage to the vehicle during the hire, and this until the vehicle is returned in accordance with the article 4 described above. The total value of the vehicle is available on simple request at the rental office. The responsibility restrictions apply per accident, i.e. per individual case. The renter agrees that all damages shall be paid from his remote sales credit card. The renter and the other drivers of the scooters shall be liable, at least for the part not covered by the public liability insurance, for all damage, however caused, inflicted or arisen to the scooters and to third parties, irrespective of whether this damage is the result of the renter's or third parties' fault. Step Tours and Visit Kinrooi vzw are not liable for any damage caused to the renter or the other drivers, their personal belongings and/or third parties, regardless of how it was caused. In case of an accident, theft or attempted theft the renter shall report this to the police and inform Visit Kinrooi.
Art. 7. Payment
The hirer undertakes to pay the following amounts in cash at the start of the rental of the vehicle or as otherwise agreed . a.) The amount of the rental, calculated according to the applicable rate and based on the number of rental days. b.) The rental price includes the number of chosen scooter(s) of the type NINEBOT - SEGWAY MAX G30, 100% charged battery, technical explanation when collecting the step(s). The step is equipped with:
- carrying bag attached with hanging brackets;
- lock with key, name plate and key cord or key ring;
- charging cable;
- info sheet;
- some flyers.
Art. 8. Payment modalities
Via bank account to Visit Kinrooi or in cash. Invoices must be disputed within eight days of invoice date. Invoices are payable via the online booking system. If payment is not made by the due date of the invoice, a default interest of 10% per annum shall be payable by operation of law and without prior notice, as well as an irreducible and fixed compensation of 10% of the outstanding balance with a minimum of €75,00.
Art. 9. Collection costs
In addition to the penal clause and the default interest, the tenant will be held responsible for the costs of judicial collection as stipulated in the Act of 21 April 2007 and the Royal Decree of 26 October 2007.
Art. 10. Changes to the contract
Any changes made to the terms and conditions of this contract that have not been agreed in writing shall be void and of no effect.
Art. 11. Nullity
The nullity of one or more clauses of the contract shall in no case entail the nullity of the other clauses or of the contract. Should any clause of this contract prove to be null and void in whole or in part, the remaining clauses shall remain in full force and effect.
Art. 12. Jurisdiction of the courts
The contract is subject to Belgian law. Any dispute arising therefrom shall be subject to the competent courts. Rental contract read and approved by the tenant.
Art. 13. Protection of personal data
Visit Kinrooi considers the tenant's privacy important. Visit Kinrooi handles the personal data collected by the tenant in a secure and confidential manner. Any complaints, comments or questions regarding the processing of personal data can be addressed to welkom@visitkinrooi.com. Personal data processed for performance of the contract are: first name, surname, address, bank account number, date of birth, telephone number and email address. By signing the agreement, you authorise Visit Kinrooi to process your personal data. The personal data will be kept and processed by Visit Kinrooi for the period necessary in function of the purposes of processing and in function of the contractual relationship. Your personal data will not be sold, granted, distributed or made available to third parties.
